Jammu Court Orders FIR Against Medical Officer, Three Others for Alleged Property Forgery

Jammu, Feb 28:

In a significant development, the court of the 4th Additional Munsiff (JMIC), Jammu, presided over by Hina Parveen Goney, has directed the SSP Crime Branch, Jammu, to register an FIR against a Medical Officer and three others for allegedly conspiring to grab a prime residential property in Channi Himmat, Jammu, through forgery and impersonation.

The Allegations

The case stems from a complaint filed by Dr. Indira Bhagat, a resident of Ann Arbor, Michigan, USA. Dr. Bhagat, the elder sister of the prime accused, Dr. Dimple Bhagat, claims to be the absolute owner of the residential house located in Sector 5, Channi Himmat.

According to the complaint:

  • Breach of Trust: The complainant had allowed her younger sister, Dr. Dimple Bhagat, to reside on the ground floor of the property purely as a gesture of goodwill due to her accommodation issues.

  • The Forgery: It is alleged that taking advantage of the complainant’s absence in the USA, Dr. Dimple Bhagat, along with her husband Rakesh Kumar Bali and two other associates—M.L. Bali and Puneet Resutra—hatched a criminal conspiracy.

  • Fabricated Agreement: The accused allegedly manufactured a fake “Agreement to Sell” dated April 16, 2019, and forged the complainant’s signatures to falsely claim ownership of the property.

Court’s Directive

After hearing the arguments presented by Advocates S. Z. Ahmed and Mohd. Ausman, the court invoked its powers under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

The court has ordered the registration of an FIR for the following offences:

  • Cheating

  • Forgery and use of forged documents

  • Impersonation

  • Criminal Conspiracy

The court has further mandated that the Crime Branch conduct a fair, impartial, and expeditious investigation into the matter.

The Accused Persons

The court has named the following individuals as accused in the directive:

  1. Dr. Dimple Bhagat: Medical Officer, Urban Health Centre, Bahu Fort, Jammu.

  2. Rakesh Kumar Bali: Husband of Dr. Dimple Bhagat.

  3. M.L. Bali: Resident of Trikuta Nagar, Jammu.

  4. Puneet Resutra: Resident of Rehari Colony, Jammu.
