Jammu, Feb 6:
In a significant diplomatic and political move, Aga Syed Muntazir Mehdi, Member of the Jammu and Kashmir Legislative Assembly (MLA) and a member of the Assembly’s Ethics Committee, has formally reached out to Union Home Minister Amit Shah. The legislator is seeking the immediate withdrawal of First Information Reports (FIRs) reportedly lodged against Kashmiri youths for expressing solidarity with Palestine.
The letter, dated February 6, 2026, argues that the youth were acting in alignment with India’s own long-standing foreign policy and diplomatic stance.
The Constitutional & Diplomatic Argument
In his communication, Aga Muntazir highlighted that the Government of India has a rich history of supporting the Palestinian cause through both humanitarian and diplomatic channels. He specifically cited two recent major milestones:
-
The 2nd India–Arab Foreign Ministers’ Meet: Held recently in New Delhi.
-
The Delhi Declaration (2026): A document that reaffirmed India’s commitment to justice, dialogue, and a sovereign Palestinian state.
The MLA noted that the act of holding Palestinian flags or peaceful expressions of solidarity should be viewed as a reflection of India’s official international position rather than an attempt to disturb public order.
Concerns Over Youth Alienation
Aga Muntazir expressed deep concern that criminalizing these peaceful expressions could have long-term negative effects on the region’s stability.
“At a time when confidence-building and constructive engagement with the youth of Jammu and Kashmir are crucial, such measures may convey a sense of inconsistency and injustice,” Mehdi wrote in the letter.
He emphasized that these legal proceedings risk:
-
Undermining democratic freedoms guaranteed under the Indian Constitution.
-
Creating a sense of alienation among the younger generation.
-
Weakening public faith in the uniform application of the rule of law.
The Plea for Compassion
The PDP legislator urged Home Minister Amit Shah to intervene with “compassion and constitutional foresight.” He argued that withdrawing the FIRs would send a powerful message of reassurance to the people of Jammu and Kashmir, signaling that the state respects democratic expression and values youth engagement.
| Key Argument | Basis |
| Foreign Policy Alignment | Expressions match India’s support for the 1967 borders and a two-state solution. |
| Peaceful Intent | Protests were described as non-violent with no intent to cause public disorder. |
| Democratic Values | Aligning domestic law enforcement with constitutional rights to free speech. |
Background: A New Voice in Budgam
Aga Syed Muntazir Mehdi recently won the Budgam Assembly seat in a by-election, marking a significant shift in the region’s political landscape. Since his maiden speech in the Assembly earlier this week, he has been vocal about religious profiling, the use of the Public Safety Act (PSA), and the need for the government to fulfill promises regarding the release of political prisoners.
