Deputy Attorney General Godfred Yeboah Dame has told the Supreme Court that comments made by the Assin Central Member of Parliament, Kennedy Agyapong, on his Net2 TV are clearly scandalous.

In defending the High Court against the MP, Mr Dame prayed the Court to reject the application filed by the lawyers of the MP because the High Court judge, Justice Amos Wuntah Wuni, sitting on the contempt case, has the jurisdiction to hear the matter.

He was handed the affidavit in opposition filed by the registrar of the High Court to argue the matter in the Supreme Court.

He argued that the comments were directed at a high court judge which presupposes that the whole High Court has been scandalized, so any judge at that level could sit on matter and pronounce judgment.

Supporting his argument, lead counsel for Kennedy Agyapong Kwame Gyan argued that the fact that the High Court judge, Justice Amos Wuntah Wuni, has assumed that the alleged contempt comments were directed at him makes him an interested party, thereby making him unfit to sit and pronounce judgment on the matter.

He prayed the Court to prohibit the judge from sitting on the matter, saying his client will rather prefer a different judge takes over the case.

He argued that the comments made by the MP were not directed at Justice Wuntah Wuni but a different High Court judge.

But the panel questioned if counsel for the MP was not contradicting himself since the judge sitting on the matter was not the one the comments were directed at.

He responded by indicating that the judge had assumed he is the one the comments were directed at so he is an interested party who is not supposed to sit on the matter.
